PUBLISHING LAW AND FIRST AMENDMENT

In our publishing law practice, we represent book publishers and authors in all aspects of publishing law. We read manuscripts for potential libel, copyright and invasion of privacy problems. We advise both publishers and authors regarding the terms of publishing contracts. When lawsuits occur, we represent our publishing clients and authors in libel, copyright infringement and privacy invasion litigation. Although we represent both plaintiffs and defendants in copyright infringement cases, in our libel law practice, we generally represent defendants, because of the First Amendment interests that define the law of libel.

Cases of interest include McFarlane v. Sheridan Square Press, a libel case in which we successfully represented a publisher and author sued by President Nixon’s National Security Advisor over assertions involving his involvement in the Iran-Contra Affair, and the successful defense of a publisher and author in a copyright infringement suit brought by the Church of Scientology involving a biography of L. Ron Hubbard, the Church’s Founder. We have also represented Air America Radio, the liberal talk-show network, in a variety of communication-related matters, and an Australian publishing company which has rights to the works of Che Guevara.
